Lol I didn't have a lawyer.
I might seem to be playing devil's advocate to you but the fact remains, you
can't be too simplistic about these matters.
Jack says the new application is cool to file. At the best case senerio her
old case will go to Alj and be positive. The new case will die a silent
death. Worst case is after Alj stage she still is running into the brick
wall then dropping the old case is possible BUT (and this is crucial) make
sure that the onset date is set for before her credits expired or will
expire in the second case.
Then the battle continues. Even if she would chose to stick with the
original case untill the very bitter end That new case theoreticaly could be
in the shadows working in her behest.
The important thing is to make sure the appeal to Alj gets taken care of
before the sixty day deadline. That's where to spend the energy. Do that and
then file the new case at her leasure after further consideration.
