I see what you are saying here. about the credits.. I have relayed that
on to this nutty lawyer.
I've tried to tell him.. that this so called new illness as he claims I
have is not a new illness but in fact the docs have just now put a name
on my illness but he dont see it that way.. hes the lawyer but im the
client.. he needs to realize this and not just say well I dont know what

A new initial application will take 100 days to process. To get your
case before the Appeals Council might take a year.
If your work credits ran out before the ALJ's decision, the new
application won't do you any good. You'll have to continue to the
Appeals Council or else your case will be dismissed as res adjudicata.
If your work credits ran out after the ALJ's decision, it's OK to file a
new application but make sure that your alleged onset in your new
application is not after the work credits ran out.
If your work credits are still running, no problem.
